1About these Terms

1.1 Who we are. Goonbate™ is run by Sir Dominic Scott, a sole proprietor based in Glasgow, Scotland ("we", "us", "our"). Sir Dominic Scott is also the creator and rights holder of the Goonbate™ content.

1.2 What Goonbate is. Goonbate™ is a membership that gives access to adult audio hypnosis made for gooning, and to extras that depend on your tier (together, the "Membership"). The audio, text, images, video and other material made available through it are the "Content". The Membership is sold and delivered through Patreon. goonbate.com (the "Website") shows what the Membership is and sends you to Patreon to join.

1.3 Who these Terms apply to. These Terms apply to everyone who visits the Website, joins or holds a Membership, listens to the Content, or uses a Goonbate perk in The Haus of Sir Discord server ("you").

1.4 The documents that apply.

  1. These Terms: the Membership, the Content, the perks, your conduct and what happens if things go wrong.
  2. Patreon's Terms of Use and policies, including its community guidelines and its rules for creators' benefits: your Patreon account, payments, billing, refunds and your conduct on Patreon. You agree to them with Patreon when you join, and they bind you alongside these Terms. Breaking them is also a breach of these Terms, and Patreon may act against your account under its own rules.
  3. Discord's terms and the rules of The Haus of Sir: your use of Discord and of the server.
  4. The Privacy Policy at goonbate.com/privacy: how personal data is handled. It is information, not a contract term.

1.5 If they conflict. For payment, billing and anything Patreon controls, Patreon's terms apply. For what you may do with the Content, your conduct and your access to the perks, these Terms apply. Where both set a rule, you must follow both.

1.6 Not The Vault+ Liberated. The Vault+ Liberated is a separate, free archive with its own licence. Goonbate™ Content is not covered by that licence unless it has been expressly released under it.

2Accepting these Terms

2.1 How you accept. You accept these Terms when you join a Membership, or when you use the Website, the Content or a perk, whichever happens first. Joining also means accepting Patreon's terms.

2.2 Read them first. Please read these Terms and the Privacy Policy before you join. If you do not agree, do not join and do not use the Content.

3Who can join

3.1 Age. You must be 18 or over, and at least the age of majority where you live if that is higher. The Content is sexual, hypnotic and intended for adults only. The Website asks for your date of birth before it opens, and Patreon has its own age rules.

3.2 Where you are. Adult material must be legal for you to access where you are. It is your responsibility to check.

3.3 Capacity. You must be able to enter into a binding agreement, and you must be joining for yourself as a consumer, not for a business.

3.4 True information. The information you give us, Patreon and Discord must be true, including your date of birth.

3.5 Under 18. If you are under 18, you must not use the Website, join or listen. If we learn or reasonably believe that someone under 18 has a Membership or access to a perk, we will end that access and remove them from any Goonbate spaces in The Haus of Sir, and delete what we hold about them that we are not required to keep.

3.6 People we have removed. If we have ended your access under section 12, you must not join again, including with another account, unless we agree in writing.

4Your Membership

4.1 Tiers. The Membership comes in tiers. Each tier's name, monthly price and what it includes are shown on Patreon and on the Website. What your tier includes is what was shown on Patreon when you joined or last changed tier, as updated under section 4.6.

4.2 Where the Content is. The Content is streamed on Patreon, in its app or in a browser. It is not offered for download. Some tiers also unlock channels and roles in The Haus of Sir on Discord.

4.3 Your account is yours. A Membership is for one person. You must not share your Patreon or Discord login, let anyone else listen through your account, or share links, files or passwords that give access to the Content.

4.4 Discord roles. To get the Discord perks of your tier, link your Patreon account to Discord. Your tier role is given and removed automatically based on your Membership. One tier role applies at a time. Roles and channel access end when your Membership ends or lapses.

4.5 Changing tier. You can move up or down a tier at any time from your Patreon memberships page. Patreon works out any difference in price.

4.6 The library changes. New Content is added over time. Content may be edited, moved between tiers or removed, for example to fix a fault, for legal reasons, or to keep the library consistent. A Membership gives access to the library as it stands while you are a member. It does not guarantee that any particular file stays available.

5Perks that involve Sir Dominic Scott personally

5.1 Direct access and priority replies. Where a tier includes direct access to Sir Dominic Scott or priority replies, that means messaging him through the channels named for that tier in The Haus of Sir or on Patreon. He reads messages personally and replies as his schedule allows. There is no guaranteed response time, length or type of reply, and no right to calls, meetings, live sessions or personal content unless a tier says so.

5.2 File requests. Where a tier includes file requests, you can send in requests for what you want to hear: a theme, a kink, a scenario, a trigger. File requests are a general system that makes sure your requests are heard specifically. Sir Dominic Scott reads them and uses them to shape what Goonbate makes. A request is not an order for a custom or personal file. There is no promise that any particular file will be made, when, or in what form, and anything that is made is general Content for members. Requests involving a real, identifiable person without their consent, anyone under 18, anything illegal, or anything that would put anyone at risk are not considered. Requests have no cash value.

5.3 Better Hypno. Where a tier includes a PDF copy of Better Hypno, it is the one file you may keep. That copy is for you alone, and section 7 applies to it in the same way as the rest of the Content.

5.4 A professional relationship. Sir Dominic Scott is a professional identity. The Content, the perks and any messages are part of a paid adult service. They are not a friendship, relationship, mentorship or therapy, however real the feelings they create may be. You must not seek out, contact or share information about his private life, personal connections or whereabouts, or contact him outside official channels.

5.5 Limits. We may pause or limit direct access, replies or requests for anyone who misuses them, for example by sending abusive, excessive or unlawful messages, or who breaks section 5.4.

6Payment, cancelling and refunds

6.1 Patreon takes payment. Payment is taken by Patreon, not by us, using the method you give Patreon. Your bank or card statement shows Patreon. We never see or store your card details.

6.2 Price and currency. Prices are monthly and in US dollars. Your bank may convert the amount into your own currency and may charge a fee for doing so. Patreon may add taxes such as VAT, depending on where you live, and shows the total before you pay.

6.3 When you are charged. You are charged when you join. After that you are charged each month, on the schedule Patreon shows on your memberships page, until you cancel. By joining you authorise these recurring payments.

6.4 Failed payments. If a payment fails, Patreon may try again. If it cannot take payment, your Membership, your Discord roles and your access to the Content may pause or end until payment is made.

6.5 Price changes. We may change a tier's price. If a change affects what you pay, we will tell you before it applies, on Patreon, and you can cancel before then.

6.6 Cancelling. You can cancel at any time in your Patreon account. There is no minimum term. After you cancel you keep access until the end of the period you have paid for, and you are not charged again.

6.7 Refunds. Because Patreon takes payment, refund requests go through Patreon and its refund policy. We do not give refunds, including for part of a period or for a period in which you did not use the Membership, unless the law requires it.

6.8 Your right to cancel within 14 days. If you are a consumer in the UK or the EU, you may have a legal right to cancel a digital content purchase within 14 days. That right ends once you start to access the Content, where you agreed to access starting straight away and acknowledged that you would lose the right to cancel. Where that right still applies, you can use it through Patreon or by contacting us.

6.9 Problems with Content. If Content will not play or does not match its description, tell us and we will look at it. Any right the law gives you in that case is not affected by section 6.7.

6.10 Payment disputes. If you think a charge is wrong, please contact Patreon or us first, as this is the quickest way to fix it. If you open a chargeback or payment dispute, we may pause your access while it is resolved, and we may give Patreon or your bank information about your Membership and your use of it, such as when you joined and what you accessed. If a dispute is found to be unjustified, we may recover any amount you still owe for a period you received. We will not charge you more than you owe.

7The Content: ownership and what you may do with it

7.1 Ownership. The Content is the work of Sir Dominic Scott and is protected by copyright and other rights. Joining, listening, or holding any copy does not transfer ownership of any of it. All rights not expressly granted in these Terms are reserved. Goonbate™, Get Worse™ (UK registered trade mark UK00004091922), Haus of Sir™ and Sir Dominic Scott© are his names and marks, and no licence to use them is given.

7.2 Your licence. While you hold a Membership, you have a personal, non-exclusive, non-transferable, revocable licence to stream the Content your tier includes on Patreon, and to listen to or view it privately for your own non-commercial use. The licence ends when your Membership ends.

7.3 No downloads. The Content is for streaming only. You must not download, save, record or keep copies of it, by any means, including through Patreon features, browser tools, screen or audio recording, or third-party apps. The only exception is the Better Hypno PDF where your tier includes it (section 5.3). If you hold a copy of any other Content, you must delete it.

7.4 What you must not do. Unless Sir Dominic Scott has given written permission, you must not:

  1. share, send, upload, post, stream, torrent or otherwise make any Content available to anyone else, in full or in part, including in private groups, chats or file-sharing sites;
  2. sell, rent, lend or trade the Content or access to it;
  3. put the Content behind any paywall, subscription, paid membership or tip requirement, or use it in any paid or monetised service or content of your own;
  4. copy, edit, remix, rerecord, re-voice, perform, translate or adapt the Content, or its scripts, triggers, soundscapes or techniques, to make something for anyone other than yourself;
  5. download, record, rip or capture Content from Patreon or anywhere else;
  6. remove or change any copyright, ownership or identifying notice or information in the Content;
  7. use the Content, or anything made from it, to train, fine-tune, test or build any artificial intelligence or machine-learning model or dataset, or to make a synthetic copy of Sir Dominic Scott's voice or work;
  8. use scripts, bots or other automated tools to collect, download or index the Content;
  9. present any Content as your own, or suggest that anything you made is official or endorsed by us.

7.5 Where the law allows more. Nothing in these Terms stops you doing anything the law allows you to do with copyright material regardless of any contract.

7.6 Copyright and takedowns. If you see Goonbate™ or other Sir Dominic Scott Content shared without permission, or if you believe something we have published infringes your rights, email hello@sirdominic.scot with the address of the material and why. We act on genuine reports promptly.

8Hypnosis and adult content

8.1 What it is. The Content is erotic hypnosis for adults. It uses suggestion, repetition, trance techniques and explicit sexual themes. It is made for entertainment and pleasure. It is not medical treatment, therapy or advice.

8.2 Your choice. Whether and how to listen is your decision. If you have a mental health or neurological condition, such as epilepsy, or any doubt about whether hypnosis is right for you, speak to a qualified professional first. Stop listening if you feel unwell or distressed.

8.3 Safety. Never listen while driving, operating machinery, or doing anything that needs your full attention.

8.4 Other people. Never play the Content to, or use it on, another person without their informed, freely given and ongoing consent. Never use it with anyone under 18.

9The Haus of Sir and your conduct

9.1 Community rules. Goonbate Discord perks are in The Haus of Sir. The server's rules and Discord's terms apply there as well as these Terms.

9.2 Respect. You must treat other members, staff and moderators with respect. Harassment, threats, hate, doxxing, stalking, sharing private information or images without consent, and attempts to get round a moderation decision are not allowed.

9.3 Moderation. Staff and moderators may remove messages, restrict channels, time out or remove members to keep the server safe, in line with its rules.

10Using the Website and the service properly

You must not:

  1. give false information, including your age, to the Website, Patreon or Discord;
  2. share your account, or get round a tier, a role or any access limit;
  3. try to access Content you have not paid for, other people's accounts or data, or parts of our systems that are not meant for you;
  4. probe, scan or test the Website or our systems for weaknesses, or exploit one you find (tell us instead);
  5. interfere with the Website, Patreon, Discord or other people's use of them, or send anything harmful or malicious;
  6. copy the Website's design, code or text to run a similar or competing service;
  7. impersonate anyone, including Sir Dominic Scott or a member of staff;
  8. use any part of the service to break the law or to harm, exploit or deceive anyone.

11Changes to the service

11.1 Changes. We may change the Website, the tiers, the perks and the Content, add or remove tiers, or move the Membership to another platform. If you do not like a change, you can cancel at any time.

11.2 Closing. We may stop offering the Membership at any time. If we do, no further monthly charges will be taken after it stops.

12Breaches and what we can do

12.1 Proportionate action. If you break these Terms, or we reasonably believe you have, we may take one or more of these steps, depending on how serious the breach is and what is needed to deal with it:

12.2 Suspension while we check. We may suspend access while we look into a possible breach. If we find there was no breach, we will restore it.

12.3 Immediate action. We may act at once and without warning where that is needed to protect the Content, other members, staff, our rights or anyone's safety, or to comply with the law.

12.4 Payments after a breach. If we end your Membership for a serious breach, we will stop further charges. We do not refund the period in which the breach happened unless the law requires it.

12.5 Contract and crime are different. Breaking these Terms is a breach of contract. It is not in itself a crime. Some conduct that breaks these Terms may also break the law, for example sharing the Content on a commercial scale, harassment, or giving sexual material to a child, and that is a matter for the relevant authorities.

12.6 What survives. Ending a Membership does not affect rights and remedies that arose before it ended, and does not end the parts of these Terms that are meant to continue, including sections 5.4, 7, 12, 14, 15, 16 and 18.

13Third-party services

The Membership relies on services we do not control, including Patreon, Discord, your app store, your device and your internet provider. Their own terms and privacy policies apply to your use of them. We are not responsible for their availability, their decisions about your accounts, or their handling of your data.

14Provided as it is

14.1 No promises. The Membership, the Content, the perks and the Website are provided as they are and as available. As far as the law allows, we make no promise of any kind about them, including that they will produce any effect, suit you, be available, work on your device, or be free of errors.

14.2 Your own risk. You listen, join and take part at your own risk.

15Liability

15.1 No liability. As far as the law allows, we have no liability to you of any kind, however it arises, for anything connected with the Membership, the Content, the perks, the Website, Patreon, Discord or The Haus of Sir. That includes any direct or indirect loss, damage, cost, injury to feelings, or loss of data, money or opportunity.

15.2 What the law does not let anyone exclude. Section 15.1 does not exclude liability for death or personal injury caused by negligence, for fraud, or anything else the law says cannot be excluded, and it does not take away any statutory right you have as a consumer. It applies to everything else.

16Your responsibility for misuse

If you break these Terms and that causes us a claim, loss, liability or expense, for example by sharing the Content, you may be responsible for the loss that results and for reasonable legal costs, as far as the law allows. This covers only loss your breach actually caused, and it does not take away any right you have as a consumer.

17Changes to these Terms

17.1 Updates. We may update these Terms, for example when the Membership, the law or Patreon's rules change. The date at the top shows the current version.

17.2 Notice. If a change significantly affects members, we will tell you on Patreon or in The Haus of Sir before it takes effect. Continuing your Membership after that date means you accept the new version. If you do not agree, you can cancel before it takes effect.

18General

18.1 Whole agreement. These Terms, together with the documents in section 1.4, are the whole agreement between you and us about the Membership. They replace anything said or written about it before.

18.2 If part is invalid. If a court decides any part of these Terms is invalid or unenforceable, the rest stays in force, and that part applies to the greatest extent the law allows.

18.3 No waiver. If we do not enforce a term straight away, we can still enforce it later.

18.4 Transfer. We may transfer our rights and obligations under these Terms to someone who takes over running Goonbate™. We will tell you if that happens, and it will not reduce your rights. You may not transfer your rights, your Membership or your access to anyone else.

18.5 No partnership. Nothing in these Terms creates a partnership, employment, agency or joint venture between you and us.

18.6 Events outside our control. We are not responsible for delay or failure caused by events outside our reasonable control, such as a failure of Patreon, Discord, our hosting or the internet, a cyberattack, power failure, or action by a government or regulator.

18.7 Notices. We may contact you through Patreon, through Discord, or by email to the address on your Patreon account. You can contact us by email at hello@sirdominic.scot.

18.8 Other people. Only you and we have rights under these Terms. No one else can enforce them.

18.9 Reading these Terms. Headings and "the short version" are for convenience and do not change the meaning. "Including" and "for example" mean without limitation. These Terms are written in English, and the English version is the one that applies.

19Complaints and the law

19.1 Talk to us first. If you have a complaint, email hello@sirdominic.scot. We aim to reply within 14 days.

19.2 Governing law. These Terms are governed by the law of Scotland.

19.3 Courts. The courts of Glasgow, Scotland have jurisdiction. If you live elsewhere in the United Kingdom, you may also bring proceedings in the courts where you live. If you live outside the United Kingdom, you keep any protection the mandatory law of your country gives you.
